1. Acceptance of Terms

By accessing and using the Evergreen Trails Travel website and services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services or website.

These terms constitute a legally binding agreement between you and Evergreen Trails Travel Inc., a Canadian corporation operating wilderness adventure tours and travel services throughout Canada.

2. Service Description

Evergreen Trails Travel provides premium eco-friendly wilderness adventure tours, cultural experiences, and travel planning services throughout Canada. Our services include but are not limited to:

• Guided wilderness expeditions and nature tours
• Wildlife photography workshops and educational programs
• Cultural immersion experiences with indigenous communities
• Custom adventure planning and consultation services
• Equipment rental and outdoor gear recommendations
• Transportation coordination and accommodation booking

All services are subject to availability, weather conditions, and seasonal variations that may affect tour operations and itineraries.

3. Booking and Payment Terms

Booking Process

All bookings must be confirmed through our official website, authorized representatives, or direct communication with our booking team. Verbal agreements are not binding until confirmed in writing with a signed booking contract.

Payment Schedule

A non-refundable deposit of 25% of the total tour cost is required to secure your booking. The remaining balance must be paid no later than 45 days before the tour departure date. Failure to complete payment may result in booking cancellation without refund.

Pricing and Currency

All prices are listed in Canadian Dollars (CAD) unless otherwise specified. Prices are subject to change without notice until full payment is received and booking is confirmed. Additional fees may apply for special requests, equipment rental, or premium accommodations.

4. Cancellation and Refund Policy

Client Cancellations

• More than 60 days before departure: Full refund minus booking deposit
• 31-60 days before departure: 50% refund of total payment
• 15-30 days before departure: 25% refund of total payment
• Less than 15 days before departure: No refund available

Company Cancellations

Evergreen Trails Travel reserves the right to cancel tours due to insufficient enrollment, extreme weather conditions, safety concerns, or circumstances beyond our control. In such cases, clients will receive a full refund or credit toward future bookings.

Force Majeure

Neither party shall be liable for delays or cancellations due to acts of God, natural disasters, government restrictions, pandemic-related closures, or other unforeseeable circumstances beyond reasonable control.

5. Safety and Participation Requirements

Health and Fitness

Participants must possess adequate physical fitness and mental preparedness for wilderness activities. Medical conditions, disabilities, or health concerns must be disclosed during booking to ensure appropriate tour selection and safety preparations.

Age Requirements

Minimum age requirements vary by tour type. Participants under 18 must be accompanied by a parent or legal guardian. All minors require signed parental consent forms and may have restricted access to certain activities.

Safety Compliance

All participants must follow guide instructions, safety protocols, and equipment usage guidelines. Failure to comply with safety requirements may result in removal from the tour without refund. Participants engage in activities at their own risk.

6. Liability and Insurance

Limitation of Liability

Evergreen Trails Travel acts as an organizer and coordinator of travel services provided by independent suppliers. Our liability is limited to the cost of services provided and does not extend to personal injury, property damage, or consequential losses.

Travel Insurance

Comprehensive travel insurance is strongly recommended and may be required for certain expeditions. Insurance should cover medical emergencies, evacuation costs, trip cancellation, and equipment replacement. Participants are responsible for obtaining adequate coverage.

Waiver of Claims

By participating in our tours, clients acknowledge the inherent risks of wilderness activities and agree to hold Evergreen Trails Travel harmless from claims arising from normal tour operations, weather-related delays, or participant negligence.

7. Environmental Responsibility

All participants must adhere to Leave No Trace principles and environmental protection guidelines. Damage to natural environments, wildlife harassment, or violation of conservation rules may result in immediate removal from tours and potential legal consequences.

Evergreen Trails Travel is committed to sustainable tourism practices and expects all clients to respect indigenous lands, cultural sites, and protected wilderness areas visited during our expeditions.

8. Intellectual Property

All content on our website, including text, images, logos, and multimedia materials, is protected by copyright and trademark laws. Reproduction, distribution, or commercial use without written permission is strictly prohibited.

Photographs and videos taken during tours may be used by Evergreen Trails Travel for marketing purposes unless participants explicitly opt out in writing before tour commencement.

9. Privacy and Data Protection

Personal information collected during booking and tour participation is handled according to our Privacy Policy and applicable Canadian privacy legislation. We are committed to protecting client data and will not share personal information with unauthorized third parties.

Emergency contact information may be shared with relevant authorities, medical personnel, or rescue services if required for participant safety during wilderness expeditions.

10. Dispute Resolution

Governing Law

These Terms of Service are governed by the laws of British Columbia, Canada. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of British Columbia courts.

Mediation

Before pursuing legal action, parties agree to attempt resolution through mediation with a qualified mediator in Vancouver, British Columbia. Mediation costs shall be shared equally between parties.

Limitation of Actions

Any claims against Evergreen Trails Travel must be filed within one year of the tour completion date or the date when the claim reasonably should have been discovered.

11. Modifications and Updates

Evergreen Trails Travel reserves the right to modify these Terms of Service at any time. Updated terms will be posted on our website with revision dates. Continued use of our services after modifications constitutes acceptance of the updated terms.

Significant changes affecting existing bookings will be communicated directly to affected clients with appropriate notice and options for accommodation or cancellation.
